DATA PROTECTION ACT REGISTRATION

Counsellors and Psychotherapists who keep their records (or part of them) on a computer are required by the Data Protection Act to register with the Information Commissioner. The law has recently become less clear concerning paper records where a recent case has led some commentators to suggest that it is legal to keep poorly organised paper records without registration. The extent of this exemption is unclear and our advice is that all counsellors and psychotherapists should register with the Information Commissioner.

Is registration complicated? 

Frankly yes. The registration form is constructed "on-line" for each individual applying. Put simply you must give:

Information about yourself 

say exactly what information you will keep about clients (and anyone else you have contact with - this would include your accountant and Yellow Pages for instance),

What you will do with the information - will you pass it to other people?

How you will keep it safe.

The resultant form is typically 9 pages long for a Counsellor/Psychotherapist.

Is registration expensive?

No, at present the cost is £35 a year and you can pay by Direct Debit.

How can Counselling Works help?

We will "construct" your application form for you by going to the Information Commissioner's website and specifying the information required for your form. We then provide you with two copies, one of which you send to the Information Commissioner, along with your cheque.

What does Counselling Works charge for this service

The fee will be £25 - which includes vat.
